Terms of Service

These terms are the agreement between you and HeroApply Studios ("we", "us") for the Darkest Kingdom mobile game (the "game") and the website darkestkingdom.com (the "site"). By installing or playing the game, or using the site, you agree to these terms and to our Privacy Policy. If you do not agree, do not use them.

Who can play

Darkest Kingdom is for adults. You must be at least 18 years old, and old enough to agree to a contract where you live. The game contains mature dark fantasy themes, including violence and death.

Your licence to play

We give you a personal, limited, non-exclusive, non-transferable and revocable licence to download and play the game on devices you own or control, for your own non-commercial entertainment. You may not:

• copy, sell, rent, sublicense or distribute the game or any part of it;
• reverse engineer, decompile or modify the game, except where the law expressly allows it;
• use cheats, bots, hacks, modified clients or any software that changes how the game works;
• exploit bugs instead of reporting them to us;
• buy, sell or trade accounts, items or currency outside the game;
• interfere with the game's servers or other players' enjoyment of the game.

Your account

The game creates a guest account for you the first time you play. You can link it to Apple, Google, Game Center or Google Play Games to keep your progress safe on another device. You are responsible for what happens on your account and for keeping access to your linked sign-in. If you do not link your account and lose or reset your phone, we may not be able to recover your progress. You can delete your account at any time, as described in our Privacy Policy.

Virtual items and currency

The game includes virtual items such as gold, gems, keys, chests, cards, relics, passes and other content ("virtual items"). You can earn some of them by playing and buy some with real money.

• Virtual items are licensed to you, not sold. You get a limited right to use them in the game. You do not own them.
• They have no real-world value. They cannot be exchanged for money or anything of value outside the game, and cannot be transferred to another player.
• We may change, balance or remove virtual items and how they work, for example to keep the game fair. We will not take away a paid item without a good reason, such as cheating, fraud, a refund or a chargeback.
• Chests and similar rewards give random items. The game shows the odds for each one before you open it.

Purchases and refunds

All purchases are made through the Apple App Store or Google Play and follow their terms. They handle payment, and refund requests go to them:

Except where the law or the store's rules say otherwise, purchases are final once the item is delivered. If you are in the EU or UK, you agree that digital content is delivered right away, and you understand that you lose your right to cancel once delivery starts. If a purchase is refunded or charged back, we may remove the item it gave you. If something you bought did not arrive, email [email protected] and we will put it right.

Subscriptions, if offered, renew automatically until you cancel them in your App Store or Google Play settings. Deleting the game or your account does not cancel a subscription.

Rewarded ads

Some rewards can be earned by choosing to watch an ad. Ads only play when you tap to watch one. If an ad fails to load or finish, the reward may not be given. Ads are covered by our Privacy Policy.

Fair play

If you break these terms, cheat, commit fraud or harm other players or the game, we may warn you, remove items, reset progress, or suspend or close your account. Where we can, we will tell you why. If you think we got it wrong, email us and we will look again.

Our content

The game, its characters, art, music, story, code and the name Darkest Kingdom belong to us or our licensors and are protected by copyright and trademark law. You may share screenshots and videos of your own play for non-commercial purposes, such as streams and social posts, as long as you do not suggest we endorse you.

Feedback

If you send us ideas or feedback, we may use them freely without paying you or giving you credit.

Changes to the game

The game is a live service. We may update, change, pause or end features, content or the whole game. If we shut the game down for good, we will give at least 30 days' notice in the game or on this site. Unused virtual items have no cash value and are not refunded when the game ends, unless the law requires it.

Disclaimer

The game is provided "as is" and "as available". To the fullest extent the law allows, we make no promises that it will always be available, free of bugs, or right for your needs. Nothing in these terms limits rights you have under consumer law that cannot be waived.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost data, profits or goodwill. Our total liability to you for any claim about the game or these terms is limited to the amount you paid us in the 12 months before the claim, or 50 US dollars if you paid nothing. Some places do not allow these limits, so they may not apply to you. We do not limit liability for death or personal injury caused by our negligence, or for fraud.

Apple and Google

These terms are between you and us, not Apple or Google. If you got the game from the App Store:

• Apple is not responsible for the game or its content, and has no duty to provide maintenance or support for it.
• If the game fails to meet any warranty, you may tell Apple, and Apple may refund the price you paid for the game. Apple has no other warranty obligation.
• Apple is not responsible for any claims about the game, including product liability, legal or regulatory claims, consumer protection claims, or claims that the game infringes someone's intellectual property. We are responsible for those claims to the extent these terms say so.
• You confirm that you are not in a country under a US government embargo and are not on a US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Your use of the game must also follow the App Store or Google Play terms that apply to you.

Ending this agreement

You can stop at any time by deleting the game and your account. We may suspend or end your access if you seriously or repeatedly break these terms, or if the law requires it. The sections on virtual items, our content, disclaimer and liability continue after the agreement ends.

Changes to these terms

We may update these terms. We will change the date at the top and, for important changes, tell you in the game before they take effect. If you keep playing after that, the new terms apply.
